Issues paper on a Digital Duty of Care
The Australian Government has committed to legislating a Digital Duty of Care on online services to help prevent serious online harms to Australians. A duty of care on online services, requiring them to take reasonable steps to prevent foreseeable online harms, was a key recommendation of the Statutory Review of the Online Safety Act 2021.
An issues paper has been developed on a proposed Digital Duty of Care framework. The framework was informed by consultation the Government conducted between late 2025 and early 2026. The design of the Duty will be informed by ongoing consultation.
