The Australian Government has released an exposure draft of the Online Safety Amendment (Digital Duty of Care) Bill 2026.
To provide feedback on the draft Bill, please email digitaldutyofcare@communications.gov.au. The closing date for feedback is 12pm 22 September 2026. Please ensure feedback is no longer than 5 pages.
The department will consider feedback provided on the exposure draft of the Online Safety Amendment (Digital Duty of Care) Bill 2026 but will not publish your comments. A summary of all feedback received may be published on the department's website. The Department will not consider feedback which contains abusive or offensive material.

Online Safety Amendment (Digital Duty of Care) Bill 2026 - Exposure draft
Your email, including any personal information supplied, is being collected by the Department of Infrastructure, Transport, Regional Development, Communications, Sport and the Arts (“the Department”) in accordance with the Privacy Act 1988.
Use
The Department may use your comments to inform consideration of issues relating to online safety and the development of a Digital Duty of Care and will store this information securely.
Disclosure
The Department will not publish individual comments, publish your personal information or disclose your personal information to third parties unless authorised or required by law.
Publication
Aggregated feedback may be published in part or in full on the Department’s website or in any public response by the Department. When publishing, the Department will redact all personal contact details of participants and any other identifying information.
Access
The Department will securely store your personal information. The Department’s privacy policy contains information regarding complaint handling processes and how to access and/or seek correction of personal information it holds. Further information is available on our Privacy page.
The department may use technology (including Artificial Intelligence (AI) tools) to support consultation on the exposure draft of the Online Safety Amendment (Digital Duty of Care) Bill 2026. This may include using AI to identify abusive or offensive language and summarise feedback, including any non-confidential response you provide that may contain personal information. These activities may generate or infer new personal information about you. However, this will only collect and use this information for the purpose of policy and legislative development. The department’s use of these tools will be governed by applicable Australian Government guidance on the responsible use of artificial intelligence, and outputs will be subject to review by departmental staff.
