Data held by the department shows that there were on average 39 cyclist fatalities annually on our roads from 2018 to 2022. Additionally, in 2021 alone, 8,163 cyclists were admitted to hospital resulting from road crashes in Australia.
To reduce the number of cyclist fatalities and injuries from road crashes, we are examining the case to introduce Australian Design Rule (ADR) 98/02 mandating the fitment of AEBS in passenger vehicles and light goods vehicles entering the Australian market. This safety measure can avoid or mitigate the severity of an impact with a bicycle.
An AEBS automatically detects an imminent forward collision and activates the vehicle braking system to decelerate the vehicle with the purpose of avoiding or mitigating a collision.
The proposed ADR 98/02 is an extension of ADR 98/01, which mandates the fitment of AEBS in passenger vehicles and light goods vehicles that can avoid or mitigate the severity of a rear-end in lane collision with a passenger car or an impact with a pedestrian.
ADR 98/02 seeks to harmonise with the technical requirements of the 02 series of amendments to United Nations (UN) Regulation No. 152 – Uniform provisions concerning the approval of motor vehicles with regard to the Advanced Emergency Braking System.

Use
The Department may use your submission to inform the development of an Australian Design Rule for Advanced Emergency Braking Systems made under s12 of the Road Vehicle Standard Acts 2018.
